1. President Obama didn?t give the best speech of the week. Michelle Obama owned the prime-time hour on opening night with an emotional ode to her father, her husband, her marriage, her country, and the values at the heart of all four. It was a tough act to follow, but Bill Clinton had no problem topping her with his folksy-professor defense of Obama and, not incidentally, his own legacy. The current occupant of the office has risen to numerous occasions with thoughtful eloquence -- from his breakthrough 2004 convention keynote to his 2008 meditation on race to his moving 2011 speech after the Tucson shootings. He didn?t quite reach his own high bar in kicking off his final political campaign. There were no sweeping calls to action or requests for sacrifice, no soaring goals akin to putting a man on the moon. Ironically, Obama?s speech resembled one of Clinton?s granular, laundry-list State of the Union addresses that critics loved to pan. It should be noted, however, that the public liked them.

2. The Democrats got into as much trouble as the Republicans over their platform. These documents are supposed to be boring compilations that nobody notices, much less reads. Instead, Republicans found their no-exceptions ban on abortion in the media glare after the Todd Akin debacle, and drew attention as well for removing an assurance to protect the home mortgage deduction. Democrats cleared the social issues hurdle, smoothly adopting a new plank in support of gay marriage, but somehow neglected to mention God or their support for Jerusalem as the capital of Israel. After Obama directed that that God and Jerusalem be restored, delegates erupted in discord before finally agreeing to amend the platform. Bottom line: Dumb unforced error that handed Republicans countless ways to capitalize, from expressing indignation to publicizing the disarray to -- already -- using it in campaign ads.

3. The onstage proceedings never strayed far from war and the military, illuminating what has not always been at the forefront during the past four years of economic angst: Obama has been a wartime president. Many videos and speeches highlighted the killing of Osama bin Laden, the repeal of "don?t ask, don?t tell," the work of Michelle Obama and Jill Biden to ease the lives of military families, and the stories of individual troops and veterans. The president came close to tears describing the inspiring recovery of a soldier who had lost a leg, and was direct -- even mocking -- about opponent Mitt Romney?s approach to war and the world. The daily drumbeat went way beyond what was needed to draw a contrast with Romney?s failure last week to mention Iraq, Afghanistan and U.S. troops, and it played to one of Obama?s surprising strengths. Still, the last time a Democratic nominee took this tack -- Vietnam veteran John Kerry in 2004 -- it backfired.

4. Obamacare, officially the Affordable Care Act,?is no longer stashed in a dark corner of the attic. On the opening night themed around Hard Choices, and intermittently throughout the convention, the health law that helped spawn the tea party was treated as an achievement instead of an albatross. There were videos and speeches featuring tearful people affected by the law. It figured prominently in a video tribute to the late Sen. Ted Kennedy and in Chicago Mayor Rahm Emanuel?s inside account of the administration. It got a whole speech to itself from Health and Human Services Secretary Kathleen Sebelius. ?Obamacare is a badge of honor,? she said. Those are fighting words rarely if ever heard before from a Democrat, much less in such a high-profile setting. Obama glossed over the act in his convention speech, but he makes clear these days that he?s proud of it. As Republicans batter the regulation-heavy law as an affront to freedom and vow daily to repeal it, many Democrats have concluded there?s no point in trying to ignore it, and in fact they may as well embrace it.

5. Amid the touching segments about troops and students and people grateful for Obamacare, the accolades from business people who said that yes, they built it, but that government investment, infrastructure and rules of the road had helped them succeed, the convention had some surprisingly shrill moments. Red meat is fine -- former governors Ted Strickland of Ohio and Jennifer Granholm of Michigan offered plenty of it -- but their edgiest lines were also hilarious. By contrast, the Democrats may have overplayed their hand on reproductive rights, capped by Sandra Fluke?s vision of a Republican-run country as something out of Margaret Atwood?s Handmaid?s Tale. And then there was Massachusetts Senate candidate Elizabeth Warren. For all she?s already done to help consumers, her polarizing rhetoric about a rigged system underscored the intensity of her personality and could turn off some voters -- even if they agree with what she said.

(AP) ? Jonathan Vilma, Scott Fujita and Will Smith are back in the NFL. For now.

The suspensions of those players, plus unsigned free agent Anthony Hargrove, for their roles in New Orleans' pay-for-pain bounty scandal were lifted Friday by a three-member appeals panel.

The league reinstated them all a few minutes later.

The Saints' Smith and Fujita, now with the Cleveland Browns, probably will play in Sunday's season openers. Vilma can at least rejoin teammates and coaches in New Orleans ? and get paid ? even if the linebacker is not yet ready to play because of knee problems.

And Hargrove can start talking to NFL teams about giving him another shot, after he was cut by the Green Bay Packers.

Still, there's no telling how long the reprieve will last.

Coming just two days before the first full slate of NFL games this season, the ruling is a setback for Commissioner Roger Goodell and the league. But while the decision allows the players to rejoin their teams, it does not permanently void their suspensions.

NFL spokesman Greg Aiello said Goodell would "make an expedited determination of the discipline imposed" for violating the league's bounty rule.

"Until that determination is made, the four players are reinstated and eligible to play starting this weekend," Aiello said.

Vilma, who had been suspended the whole season, tweeted: "Victory is mine!!!! -stewie griffin"

Added Fujita: "I'm overwhelmed with all the support. Thank you so much everyone. Can't tell you how much it means to me."

The ruling does not affect New Orleans coach Sean Payton, suspended for the season, interim coach Joe Vitt (six games) or general manager Mickey Loomis (eight games).

While the panel did not address the merits of the NFL's bounty investigation, it found that Goodell overstepped his authority in hearing the players' appeals of their punishments for participating in the Saints bounty program, which paid cash bonuses for hits that injured opponents.

The panel's decision states that Special Master Stephen Burbank, not Goodell, should discipline players for receiving money from a pool that paid for big plays. Goodell's role, the panel said, should be limited to whether he can prove the players intended to injure opponents, which would fall in the category of conduct detrimental to the game. Players and coaches implicated in the bounty pool have testified under oath in a related federal court case they never intended to injure opposing players.

"Whether the commissioner tries to readdress the situation or not is his call," said Peter Ginsberg, Vilma's attorney. "We are certainly hoping the appeals board has made it clear the commissioner tried to grab jurisdiction and impose penalties over an area he does not have oversight. ... The factual record in the court makes it clear he has acted in a biased and inappropriate manner."

In a memo sent to all 32 NFL teams after the ruling and obtained by AP, NFL legal counsel Jeff Pash emphasized that "nothing in today's decision contradicts any of the facts found in the investigation into this matter, or absolves any player of responsibility for conduct detrimental. Nor does the decision in any way suggest what discipline would be appropriate for conduct that lies within the authority of the Commissioner."

The league's investigation found that Saints coaches and players, led by former defensive coordinator Gregg Williams, ran a program from 2009-11 that offered cash payouts for hits that injured opponents. It said specific bounties were placed on quarterbacks Kurt Warner and Brett Favre in the 2009-10 playoffs.

The Saints open their season at home against Washington on Sunday, while the Browns host Philadelphia.

The NFL granted roster exemptions to the Saints for both of their suspended players and to the Browns for Fujita, meaning New Orleans could carry up to 55 players and Cleveland 54.

Earlier this week, Saints interim head coach Aaron Kromer said Smith, who participated in training camp and the preseason before he began serving his four-game suspension on Monday, would be ready to play against Washington if available.

Vilma's status was not as clear. His season-long suspension began before training camp and he has been trying to work his way back from offseason surgery on his left knee.

Saints players had just finished practice when they received word of the panel's ruling.

"It's huge," said Saints safety Malcolm Jenkins, a defensive captain. "Those are two huge leaders we've got. They're great players. We've got a talented team, but you add Will Smith and Jonathan Vilma, our talent level goes up that much. For our team, it's a break."

Even if Vilma could not play right away, Jenkins said his presence in the locker room and meetings would be valuable.

At Browns headquarters, linebacker D'Qwell Jackson was sure the 33-year-old Fujita would be able to come back and have an immediate impact.

"I'm confident Scott has been keeping his conditioning up and he knows the system," Jackson said.

"He's got what 12 years in? He'll be fine. If he's able to come back there will be a lot of excitement in this locker room."

Fujita was barred from Cleveland's training facility this week, but he stayed in town and worked out on his own at nearby Baldwin Wallace University in the event the suspension was lifted. Fujita, who serves on the NFLPA's executive committee, had expressed confidence he would be on the field in Week 1.

Hargrove, docked eight games, was released last month by Green Bay and is not currently with a team.

The appeals panel consisted of retired federal Judge Fern Smith of San Francisco, retired federal Judge Richard Howell of New York, and Georgetown professor James Oldham. It met in New York last week to hear arguments from the NFL Players Association, which appealed Burbank's ruling that Goodell had the authority to hear and rule on the players' appeals of their suspensions. NFL attorneys had asked the panel to affirm Burbank's ruling, but the panel sided in large part with the union.

The decision likely means that consolidated federal lawsuits brought against the NFL by Vilma and the NFLPA on behalf of the other three players are likely on hold until Goodell reissues punishment. It also spared U.S. District Judge Ginger Berrigan from having to decide before Sunday on a temporary restraining order requested by the players.

And having had many terrible coaches growing up, I knew exactly the coach I didn?t want to be.

We had a successful season and after it was over, I was approached by several parents asking if I would be interested in doing some one on one coaching with their kids. I agreed?

Working one on one with players and making them the best players they could possibly become.

(AP) ? Hundreds of people waited in line for an hour or more to pay their respects to the late Lucimarian Roberts, a leader on Mississippi's Gulf Coast for more than 40 years and the mother of ABC's "Good Morning America" co-host Robin Roberts.

Bradford-O'Keefe Funeral Home employees tell the Sun-Herald (http://bit.ly/RKl7yO) that at least 700 people came to the wake Tuesday evening.

A private funeral is scheduled Wednesday, with burial at the Biloxi National Cemetery next to her husband, Col. Lawrence Roberts, who died in 2004.

Lucimarian Roberts was the first black to serve as chairman of the Mississippi State Board of Education.

She died Thursday at her home in Pass Christian at age 88.

Her children also include New Orleans anchor Sally-Ann Roberts of WWL-TV.

Have we forgotten how to remember?

Before you see anything, you begin to hear it, crackling and creaking just beyond view. Then, when you actually enter the exhibition at the Design Museum in London, you find that those noises are coming from a cave - or rather, a large hall painted black, with two giant screens on opposite walls that recreate the feel of a cave. Only in this case, the crystals clinging to rocks and rising out of crevices aren?t moving in geological time. They are growing in bursts of seconds and minutes. Time is sped up and the crystals are in constant vibrant flux.

Changing our perception of time to make visible often unseen aspects of the world around us was the point of the animation, say film-makers Ruth Jarman and Joe Gerhardt, who together make up Semiconductor. ?We are really used to thinking about landscape as a static thing, but it?s a constantly changing environment,? says Gerhardt.

Their gigantic, site-specific film installation The Shaping Grows is on display as part of the Design Museum?s new Digital Crystal exhibition, in partnership with luxury crystal company Swarovski. The show features 14 different works that explore how digital culture impacts upon our memory and concept of time.
Semiconductor digitally depicted crystals inside a cave and then sped up their development by varying degrees - depending on the type of crystal - so that change could be seen by the naked eye. ?Some may form over years, some tens of thousands of years,? Jarman explains. ?We condensed the earth?s movements into a timeframe you could imagine.? The moving crystals are synced to a groaning soundtrack of seismic data, gathered from earthquake recordings over the past couple of years. ?

As well as toying with perceptions of time, many of the works on display examine our changing relationship with physical objects and the memories they summon, now that photographs, music collections and many other elements of our daily lives mainly exist in digital form. As we make this shift, do we lose something in the process?

?It?s a paradox,? says museum director Deyan Sudjic. ?On the one hand, the digital world means we all have immortality with a Twitter account.? A few generations ago a single grey image may have been the only documentation of an event ? and a single jumping-off point for a plunge into memory ? but today we can turn to digital snapshots for minute-by-minute records of events. ?Our memory muscles are not being exercised,? Sudjic says.

Lamenting the atrophy of our physical worlds, artist Maarten Baas has sculpted Thought Cloud, a dark figure, hunched within an otherwise empty, tiny black house. Yet even this dystopian portrait of a future without? physical things, or the space to house them, leaves room for optimism: out of the claustrophobic little cell, the figure?s thoughts escape in dazzling crystal clouds through a tiny chimney, growing and expanding as they rise.

We may increasingly be leaving the physical world behind, but New York-based artist Marcus Tremonto imagines a future in which we will come full circle ? and a flat digital world will be rendered three dimensional again. From a few paces away, his HOLO Center Table seems to be a mirror-surfaced dining table with a pale blue oval at the middle. Yet when you step just a bit closer, a 3D crystal vase appears above the pool of blue, projected from overhead. ?In 100 years, will we just have holographic centrepieces?? he asks.

To create the work, Tremonto used software originally developed for rendering 3D projections for military and architectural applications, and now also used for creating 3D printed objects. He imagines a future in which our photographs are not simply images, but able to bring our former selves back to three dimensions in front of us. It seems to be a future in which our need for physical objects has disappeared, but our desire for them lingers.

That desire for tangible beauty is summed up perfectly at the centre of the exhibition with a glittering, shifting and utterly dazzling chandelier made of nearly 2000 large crystals. On long strands suspended from the ceiling, these crystals rise and fall according to an ever changing, digital program. The work, by artist Frederikson Stallard, is mesmerising and delightful, at once ephemeral but unmistakably real. ?

IP Theft in China ? Cost of Doing Business or ... - Chinese Negotiation

International negotiators generally agree that contracts are of limited value for protecting IP in China ? and then only if you are willing and able to litigate. Guanxi is more an obligation than protection. Mianzi, or Face, is a humorous punch-line when it comes to ensuring compliance from a Chinese partner.

So what does work? More often than not, proper deal structure is you first, last and only hope. The basic goal of a Chinese agreement should be to keep your partner engaged, honest and committed. But the traditional Western practice of adding a few penalty clauses and bonus options to a boilerplate agreement isn?t going to cut it in China. Chinese deal structure is strategic ? not tactical. You have to start thinking about compliance and IP protections early ? and often in novel ways.

What?s wrong with traditional risk management?
As I wrote in my recent book, The Fragile Bridge: Conflict Management in Chinese Business ?? if you hand a Chinese negotiator a thick contract with penalty clauses and requirements, he just sees a rule book for a game he plans on winning. This approach works just fine in a US courtroom, but it will harm your interests in China because it undermines trust and demonstrates what a poor long-term partner you?ll be. The best negotiators in China prefer short, simple contracts and well-designed deal structures. Remember that IP theft and dissolving the partnership usually go hand-in-hand in China. They not only want your designs and technology ? they want you to hit the road. You have to write an agreement where the Chinese side serves their own self-interest by keeping you around.

The easiest IP to protect is the kind that has an expiration date. Fashion houses, international auto companies, media/entertainment producers like Disney and hi-tech brands that depend on well-publicized new releases are the businesses that have the most leverage. Sure ? Disney, Apple and Volkswagen will get counterfeited more in China than in the West, but at least their high-end business and official partners are usually pretty secure. You can?t expect your China business to be 100% water-tight, but you can avoid existential threats like the ones that sunk Danone?and other famous fails.

5 Rules for IP protecting deal structures in China.

  1. ?Have more to offer. In America, the tough negotiators say, ?what have you done for me lately?? In China, even the nice guys say, ?what will you do for me tomorrow?? Chinese negotiators are forward looking ? in both the good way and the bad way. The good news is that they base all business decisions on what is yet to come, so you always have another chance at success. The bad news is that they don?t display much loyalty. Always be prepared to enlarge the deal with new technology, markets or opportunities. There is no autopilot switch on Chinese relationships ? you must be prepared to continually prime the pump.
  2. Rising payout. Chinese negotiators are more sensitive to opportunity cost than Westerners ? and less sensitive to last quarter?s sales record. Remember ? the Chinese use cost-cutting as a tactical weapon for acquiring business and then try to beat down their own costs. This has a diminishing effectiveness, so there?s a good chance your partners in China really aren?t earning much per transaction. If the payout stays level, they may be dying from the inside out if inflation and costs are eating away at their tiny margin. Good negotiators find ways to incentivize Chinese partners with rising payouts ? not just more business as stable rates.
  3. Know your own competitive advantage. Within a few months, the Chinese side will have figured out how to manufacture your OEM product or market your brand within China. That?s means your competitive value within the partnership will be short lived and you will outlive your usefulness very quickly. If you want to keep the Chinese side engaged and loyal to the partnership, you had better have some way of continuously proving your worth. You have to be strong where they are weak, and for most Westerners that means new product development, new technology, new models or brand improvements, and international markets.
  4. Keep something in reserve. Don?t be too quick to promise exclusivity or give away your best technology. The auto industry and other high-tech manufacturers only make older or lagging-edge technology available to Chinese partners. The same goes for international marketing agreements, exclusivity, and investment. During the guanxi-building phase of the relationship, Westerners have a bad habit of promising the world. They think that because they verbally tied future benefits to specific business conditions they are safe ? but Chinese negotiators tend to hear what they want to. If you said that an exclusive partnership was contingent on selling 200,000 units for 3 consecutive months at a profit margin of 12% and expanding to 5 predetermined key markets ?all they will admit to remembering is exclusivity. Use boozy relationship-building banquets to find out what their goals and hopes are ? not to act like the rich uncle trying to buy their love and respect.
  5. Don?t bother with the wrong deal. Anything involving best effort sales, exclusive rights or co-developing a new technology for sale to Chinese third-parties is a non-starter. You?ve got to make it easier and more profitable for them to not steal from you. That means helping them to avoid temptation. Any deal that is A) too good to be true, or B) clear on your up-front obligations but murky on your payout is worse than a waste of time. Get out of there. Even if you have the brains not to sign an agreement, you are still coaching your new competition.

The bottom line is that the best negotiators in China are withholding ? they always have a lot to offer but are slow to deliver. Don?t make promises ? any incentive or technology you mention becomes an iron-clad commitment. But if you can find ways of subtly determining what they care about and making it known that you might consider someday discussing the possibility of negotiating about when you might be persuaded to share it ? well, then you have something real.

Angola's final election results will be released by the end of the week, the electoral commission said Monday, with the tally having already sealed another term for veteran President Jose Eduardo dos Santos.

"We should be able to announce the final result by the end of the week, knowing that we have until September 15 to do so," National Electoral Commission spokeswoman Julia Ferreira told AFP.

Foreign observers have given the vote a clean bill of health, in only the country's third elections since 1975, despite opposition parties saying the commission's results differed from those being registered at polling stations.

The final announcement is set to be a mere formality, with the latest partial results showing the ruling People's Movement for the Liberation of Angola (MPLA) taking 72.2 percent of the vote with 90 percent of polling stations reporting.

The main opposition National Union for the Total Independence of Angola (Unita), a former guerilla movement, had won 18.4 percent of votes, while the newcomer Casa party formed by breakaways from both main parties had obtained 5.9 percent.

"After the publication of the final results, the MPLA will announce the formation of a new government which will work for all Angolans without exception," Dos Santos said Sunday night at a ceremony to celebrate his 70th birthday, the Angop news agency reported.

Under the Angolan constitution the head of the party that wins the parliamentary vote becomes president.

Dos Santos, who celebrated his birthday on Tuesday, entered the elections seen as likely to secure another term after 33 years in power.

The foreign missions judged the polls as free and fair but have recommended improvements in accreditation for observers and access to state media for parties.

After a devastating 27-year civil war, the elections are the country's second in peacetime and the third since independence from Portugal in 1975.

Since January 2012, German has been operating a small corner store from a room in his home, where he lives with his wife and young son. The organization Rights Action, which?funds and works with community human rights and development organizations in Guatemala, was able to raise the start-up funds for this store?with support from individual donors and a small foundation.

Update on Choc Family

Unfortunately, German Choc and his parents are not able to sustain themselves financially. To help German Choc and his family live with greater economic security,?Rights Action aims to purchase a small plot of land with a small home for German Choc to live with his wife, son, and parents. The Choc family would plan to build an addition for German?s store, and adapt the house and path to be wheelchair accessible.

(AP) ? President Barack Obama was barely back in Iowa, ready to drink in the adulation of supporters, when the booze news broke: The White House beer recipe is out.

The tweet from presidential spokesman Jay Carney along the motorcade ride seemed light enough ? we're talking about honey-flavored beer here ? but it also served up a reminder of a campaign imperative. Obama wants to be the guy with whom people want to have a beer.

As constituencies go, Obama would seem to have the voting bloc locked up, given that his opponent, Republican Mitt Romney, does not consume alcohol given his Mormon faith.

But as a political symbol, beer is not just about beer.

It is about the likeable, accessible, regular guy who relates to life in the real world and enjoys popping a cold one. Sure, taste counts, but so do votes.

Romney and Obama are both wealthy men who, in the final two months of the campaign, are trying to build support and turnout among the working-class crowd.

It is why Obama's day in Iowa was not just about his speeches in two cities, but his unexpected stop in Bob Roe's Point After Pizza & Lounge in Sioux City, where one woman wore a t-shirt that said "It's never too early to tailgate."

During his term, Obama has sought to find some racial harmony over beer (there was that media-hyped "beer summit" in the Rose Garden.) He has worked the crowds in sports bars and college bars. He has bought a round for folks at the Iowa State Fair, where the standard cry of political rallies ? "Four More Years!" ? morphed into the more memorable "Four More Beers!"

And now he even brews his own.

Well, the chefs at the most famous and powerful house in America brew it for him, but it was his idea, and he bought the brewing kit.

"Brewing beer is becoming a thing that Americans are doing in their houses and garages across the country," said White House chef Sam Kass in a video posted Saturday on the White House web site. "And the president certainly thought it would be a great idea to see if would join the American people in that time-honored tradition."

The Obama team knew it had a buzz going here.

Word spread about the home-brewed White House beer last month when Obama, during another stop in Iowa, got in a conversation with a local resident about it. The president had an aide bring the man a bottle of the beer brewed in the White House kitchen.

Since then, growing interest and even a petition drive led the White House to release the recipe just as Obama starts his battleground-state tour toward the Democratic National Convention in Charlotte.

"Ale to the Chief," said the White House blog post, which included a link to the brewing process.

The White House's rookie brew crew has made three kinds: Honey Brown Ale, Honey Porter and Honey Blonde Ale, although recipes for the first two only were released on Saturday. Kass said on-site historians have determined this is the first time alcohol has been brewed or distilled at the White House.

Add that to Obama's first-term record.

Should he lose, the White House bar menu may well look different. Romney drinks Cherry Coke Zero or Diet Wild Cherry Pepsi.

Even working the bar crowd can offer a little political risk. Just as Obama roamed the pizza place on Saturday, the Iowa fans who filled the place groaned as a long touchdown was scored against their team. "I don't want to be associated with that play," Obama told three men dejected as he came to their table.

Worse yet, their pitcher of beer was empty.
